TERMS OF USE

The agreement
between us.

Version 1.0 — 16 September 2026 · Last updated 16 September 2026

These Terms of Use are the agreement between you and Lux Splendore for DroppingSparks. They also serve as the end-user licence agreement for the app. Please read them before you create an account, start a trial or buy a licence. By creating an account or using DroppingSparks you accept these terms.

1. Who we are.

DroppingSparks is made and sold by Lux Splendore, registered with the Dutch Chamber of Commerce under KvK number 76428931, VAT number NL003084277B70, at Gielis Beijsstraat 27B, 4813 EM Breda, Netherlands. You can reach us at luxsplendore@gmail.com. In these terms “we”, “us” and “our” mean Lux Splendore; “you” means the person who holds the account. These terms are written in English, and English is the language of this agreement.

2. What DroppingSparks does.

DroppingSparks is a local-network file transfer app for Mac, Windows, iPhone, iPad and Android. Files travel directly between your devices and the devices you approve, over an encrypted (TLS) connection on your local network. File contents, file names and transfer history are not sent to our server and never reach us. Our server handles only your account, your licence and your purchase records. DroppingSparks is not a backup service, a cloud storage service or a delivery guarantee.

3. Your account.

You need an account to use a trial, to buy a licence and to activate the app. You must be at least 16 years old to hold an account. You must give accurate details, including a working email address, and keep them up to date. Keep your password and your devices secure; you are responsible for everything done through your account. One person, one account: accounts, licences and trials are personal and may not be shared, sold, lent or transferred. A licence may be activated on up to five devices that belong to you. Tell us straight away at luxsplendore@gmail.com if you believe someone else is using your account.

4. Your licence.

When you buy DroppingSparks we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on up to five devices that belong to you, for your own personal use, for as long as these terms are respected. You may not resell, rent, lease, sublicense, lend or distribute the app or your licence, make it available to others as a service, or remove or alter any notices in it. You may not reverse engineer, decompile or disassemble the app, except and only as far as mandatory law expressly permits (including the interoperability and error-correction rights in the Dutch Copyright Act, Auteurswet, and the EU Software Directive). You may not work around, disable or tamper with licence checks, activation, device limits or trial limits. DroppingSparks includes third-party open-source components; those components remain governed by their own licences and notices, which you can find in the app, and nothing in these terms limits the rights those licences give you.

5. The free trial.

Each account gets one free 7-day trial. The trial is one per account across all platforms — Mac, Windows, iPhone, iPad and Android — not one per device or per platform. Nothing is charged for the trial, no payment details are required, and the trial does not turn into a paid subscription: it simply ends. When the trial ends, files you already received remain yours; you need a licence to keep sharing. We may end or withdraw trials for accounts that abuse them, for example by creating accounts to obtain repeated trials.

6. Buying DroppingSparks.

DroppingSparks costs €9.99 as a one-time purchase, including VAT where it applies. There is no subscription and nothing renews automatically. Your purchase includes the app for the platforms it is released on, activation on up to five of your own devices, and the first year of new features from the moment your licence starts. After that first year you may, if you want to, buy an optional update year for €3. That update year is a single, non-renewing purchase: it adds one year of new features from the end of your current coverage, or from the day you buy it if your coverage has already ended. You never have to buy it. Without update coverage the app keeps working: you keep everything you already have, file sharing keeps working, and you keep receiving security fixes for the version you own. Prices, VAT and available payment methods are shown before you confirm your purchase. Purchases on the website are paid through Stripe; we never receive your full card details.

7. Purchases through the App Store.

If you buy DroppingSparks or an update year inside the iOS or iPadOS app, the purchase is made through Apple’s in-app purchase system. Apple is the seller of record for that purchase and bills you: Apple’s own terms, including the Apple Media Services Terms and Conditions, govern that sale alongside these terms. Your use of the app itself is still governed by these terms. Payment questions, receipts and refunds for App Store purchases are handled by Apple.

8. Refunds and withdrawal.

For purchases made in the App Store, ask Apple for a refund through Apple’s own refund process; we cannot refund an Apple purchase ourselves. For purchases made on this website, EU and Dutch consumer law gives you a 14-day right of withdrawal, with one exception for digital content that is delivered immediately — the details, the conditions and the model withdrawal form are on our right of withdrawal page. A purchase that is fully refunded, by us or by Apple, deactivates the licence that came with it, and any devices activated under that licence stop being activated.

9. Acceptable use.

You decide what you send, what you accept and who you connect with. You are responsible for the files you transfer: for their content, for its legality, and for having the rights to share it. You may not use DroppingSparks to send malware, or to send or receive material that is unlawful, that infringes anyone’s intellectual property, privacy or other rights, or that breaks any law that applies to you. You may not use the app to attack, probe or disrupt other people’s networks or devices, to circumvent the licence, activation or trial limits, or to help anyone else do any of that. We do not see, scan, store or moderate the files you send, so these rules are yours to keep.

10. What you take care of.

DroppingSparks moves files; it does not keep copies for you. Keeping your own backups is your responsibility, and so is the security of your devices, your network and your operating system accounts. The app needs local network permission on your device to find and reach other devices, and it may ask for Bluetooth to help with nearby discovery; without these permissions it cannot do its job. Approve only the devices and people you trust, and check the pairing code on both screens before you confirm a connection.

11. Availability and changes.

We work to keep DroppingSparks and the account service running well, but we do not guarantee that they will be uninterrupted, timely, secure or error-free, or that every transfer will succeed. Features may be added, changed or removed as the app develops, and system requirements may change with new operating system versions. Signing in, activating a licence and downloading installers need an internet connection; the account service depends on third parties such as Supabase, Cloudflare, Stripe and Apple, and their availability is outside our control. We may carry out maintenance, and we will try to keep any interruption short.

12. Liability.

To the extent permitted by law, DroppingSparks is provided “as is” and we give no warranties beyond those that mandatory law gives you. To the extent permitted by law, we are not liable for indirect or consequential loss, for loss or corruption of data, for lost profits, lost savings or lost business, or for the cost of reconstituting files you did not back up. To the extent permitted by law, our total liability arising out of or in connection with these terms is limited to the amount you paid us for DroppingSparks in the twelve months before the event that caused the loss.

These limits do not apply, and nothing in these terms limits or excludes our liability, in the case of intent or deliberate recklessness on our part (opzet of bewuste roekeloosheid), death or personal injury caused by our fault, liability under product liability law, or any other liability that cannot be limited or excluded by law. Nothing in these terms limits your statutory rights as a consumer, including your legal conformity guarantee under Dutch and EU consumer law: if the app does not conform to what was agreed, you keep the remedies the law gives you, free of charge.

13. Intellectual property.

DroppingSparks, its source code, design, artwork, name and branding belong to Lux Splendore and are protected by copyright and other laws. Buying a licence gives you the right to use the app; it does not transfer ownership of anything to you. Third-party open-source components remain the property of their authors under their own licences. Your files remain entirely yours; we acquire no rights over anything you send or receive.

14. Suspension and termination.

We may suspend or end your licence and your access if you seriously break these terms — for example by sharing or reselling your licence, by circumventing activation or trial limits, by using the app unlawfully, or after a chargeback or a full refund. Where it is reasonable and possible we will warn you first and give you a chance to put things right, and we will act proportionately. If we end your licence because of a serious breach, you must stop using the app and remove it from your devices. Sections 9, 12, 13 and 17 continue to apply after this agreement ends.

15. Deleting your account.

You can delete your account at any time from inside the app, or by emailing luxsplendore@gmail.com from your account address. Deleting your account removes your account record, your licence, your activated devices and your trial record; the app stops being activated on your devices. Files on your devices are not touched — they are yours and they stay where they are. We keep the payment and invoice records the law requires us to keep, as explained in our Privacy Policy. Deleting your account does not by itself give you a refund, and a deleted account cannot be restored.

16. Changes to these terms.

We may update these terms, for example when the app changes or the law changes. Every version carries a version number and a date. If a change is material — if it affects your rights or obligations in a meaningful way — we will tell you by email or in the app before it takes effect and ask you to accept the new version; you can always decline by not accepting and deleting your account, and we will refund pro rata any update year you have already paid for and cannot use. Minor changes, such as corrections or clarifications, take effect when they are published here.

17. Law and disputes.

Dutch law applies to these terms and to any agreement between us. If you are a consumer living in the European Union, this choice of law does not take away the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of your own country of residence. Otherwise disputes are for the competent court in the Netherlands. Please write to us first at luxsplendore@gmail.com: almost everything is easier to solve that way.
